Privacy Policy

This Privacy Policy forms part of the Agreement. It also applies to the Company’s handling of personal information generally. The Company handles personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

1. Whose information we collect

  • Subcontractors (drivers) we engage, and any substitutes or representatives they use;
  • Customers and recipients of deliveries we carry out for our Clients; and
  • People who contact us or deal with us in connection with our business.

2. What personal information we collect

From subcontractors (drivers), we may collect: name, date of birth, residential address, email and mobile number; ABN and GST registration status; driver licence and other identity documents; visa and work-rights information, including VEVO check results and course or study-break evidence; bank account details and tax and payment records; insurance details; and information about deliveries performed and, for Company vehicles, GPS and telematics data.

From customers and delivery recipients, we may handle: name, delivery address, contact details and delivery instructions; and signatures and proof-of-delivery (POD) images. Much of the customer information is collected by, and handled on behalf of, our Clients under their own arrangements.

3. How we collect it

We collect personal information directly — for example through our driver onboarding forms, documents drivers provide, and VEVO checks (with the driver’s consent) — and from our Clients, who provide delivery information so deliveries can be completed. Where GPS or telematics is fitted to a Company vehicle, data is collected from that system when the vehicle is in use.

4. Why we collect and use it

To engage, verify, pay and manage our subcontractors; confirm identity, licensing and the legal right to work in Australia; carry out and prove deliveries for our Clients; meet our legal, tax, superannuation, insurance and work-health-and-safety obligations; protect our vehicles and property and investigate incidents; and run and improve our business.

5. How we share it

We may disclose personal information to our Clients (where reasonably required to provide services); our accountant, bookkeeper and professional advisers; insurers; government authorities (including the Australian Taxation Office and the Department of Home Affairs) where required or permitted by law; and service providers who help us run our business. We do not sell personal information.

6. Storage and security

We store personal information in secure business systems, including our Microsoft 365 environment, and take reasonable steps to protect it from misuse, loss and unauthorised access, modification or disclosure. Access is limited to people who need it. Some service providers may store information on cloud infrastructure located or accessible outside Australia; where that is the case we take reasonable steps to ensure it is handled consistently with this policy and the APPs.

7. How long we keep it

We keep personal information only for as long as it is needed for the purposes above, or as required by law (for example, tax and employment-related records), after which we take reasonable steps to destroy or de-identify it.

8. Access, correction and data breaches

You may ask us for access to the personal information we hold about you and ask us to correct it. If a data breach occurs that is likely to result in serious harm, we will respond in line with the Notifiable Data Breaches scheme, including notifying affected individuals and the Office of the Australian Information Commissioner (OAIC) where required.

9. Complaints and contact

If you have a concern about how we have handled your personal information, contact us at admin@fleetlinksolutions.com.au (Attention: Privacy — Director). We will respond within a reasonable time. If you are not satisfied, you may contact the OAIC at www.oaic.gov.au.
